The Hanoi People’s Court has sentenced Truong Huy San (born 1961, residing in Ho Chi Minh City) to 30 months in prison for violating Article 331 of Vietnam’s Penal Code, which pertains to abusing democratic freedoms to infringe upon state, organizational, and individual rights.

The trial took place on February 27, with a three-member judicial panel presiding. Two prosecutors from the Supreme People’s Procuracy represented the prosecution, while two defense lawyers represented the defendant.

According to the indictment from the Supreme People’s Procuracy, between 2015 and 2024, Truong Huy San allegedly authored and published multiple Facebook posts on his account, “Truong Huy San (Osin Huy Duc).” Authorities identified 13 posts that they claimed negatively impacted state interests, as well as the legal rights of organizations and individuals.

Prosecutors argued that the posts garnered significant online engagement, including likes, shares, and comments, contributing to public unrest and security concerns. As a result, they deemed legal action necessary.

During court proceedings, Truong Huy San admitted ownership and sole control of the Facebook account in question. He stated that he personally researched, wrote, and published all content, without involving others in account management.

While asserting that he had no intent to oppose the government or harm national interests, he acknowledged that some of his posts did violate Article 331 by affecting state, organizational, and individual rights.

At trial, Truong Huy San expressed regret, stating that he took responsibility for any harm caused by his writings. He formally accepted the charges and ruling of the court, acknowledging that his actions fell under the legal violations outlined in Article 331.

In his final statement, he requested leniency from the court, expressing a desire to continue contributing to society in a positive manner.

After deliberation, the court sentenced Truong Huy San to 30 months in prison.
